Antitrust

Skelton & Woody represents clients in a wide variety of antitrust and trade regulation matters. We have represented a diverse group of businesses in private antitrust litigation under both the Sherman Act and the Texas Free Enterprise and Antitrust Act. We also have extensive experience defending clients in investigations and litigation brought by the Antitrust Division of the Texas Attorney General's office. We also represent clients in intellectual property/antitrust cases in a variety of contexts. A representative sample of our lawyers' experience in the antitrust field is as follows:

Defense of the St. Paul Insurance Companies in massive antitrust litigation brought by the Texas Attorney General (settled early and favorably).

Representation of AT&T in an antitrust investigation by the Texas Attorney General's antitrust division involving alleged conspiracy with state employees to win a $100 million-plus state contract (no charges were filed).

Defense of Rio Grande Valley area funeral homes in price-fixing litigation brought by Texas Attorney General (resolved by agreement).

Defense of Crum & Forster, St. Paul, USF&G and Pennsylvania Manufacturing Association in antitrust class action litigation brought in 15 states by Milberg Weiss and other firms.

Defense of Dow Chemical Corporation in monopolization litigation involving herbicide products (summary judgment affirmed by Fifth Circuit).

Appellate work including United States Supreme Court briefing for a national environmental corporation involving intellectual property/ antitrust claims.
